2. Use of the site

You agree not to:

• Use the site in any way that breaches applicable law or regulation.
• Attempt to gain unauthorised access to the site, its servers, or any connected system or database.
• Introduce malicious code, or conduct automated scraping, load testing or denial-of-service activity without written permission.
• Reproduce, republish or resell site content beyond fair use without written permission.
• Submit false information through our forms, or submit another person information without their consent.

3. Intellectual property

All content on this site — text, design, graphics, code, logos and case studies — is owned by Surgemint or its licensors and protected by copyright and trademark law. You may view, download and print pages for your own internal business use.

For client work, intellectual property in deliverables transfers to the client on final payment as set out in the applicable services agreement. Surgemint retains ownership of pre-existing tools, frameworks, methodologies and internal know-how used to produce those deliverables.

4. Enquiries, quotes and proposals

Information on this site, including pricing, is provided for general guidance and does not constitute a binding offer. Prices are indicative and subject to scope. A binding engagement arises only when both parties sign a services agreement or statement of work.

Quotes issued by Surgemint are valid for 30 days from the date of issue unless stated otherwise.

5. Results and performance

Metrics, benchmarks and case study figures published on this site describe past engagements under particular conditions. They are not a prediction, guarantee or warranty of results in your business.

Search rankings, advertising costs and platform performance are affected by factors outside our control, including algorithm changes, auction dynamics, competitor behaviour and your own product and pricing. We do not guarantee specific rankings, traffic volumes, conversion rates or revenue outcomes.

6. Third-party links and platforms

The site may link to third-party websites and our services involve third-party advertising and analytics platforms. We do not control those parties and are not responsible for their content, terms, availability or practices. Your use of any third-party platform is governed by that platform terms.

7. Disclaimer of warranties

The site is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Surgemint disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the site will be uninterrupted, error-free or free of harmful components.

8. Limitation of liability

To the fullest extent permitted by law, Surgemint will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill, arising from your use of the site.

Our total aggregate liability arising out of or relating to the site is limited to one hundred US dollars (USD 100). Liability under a signed services agreement is governed by the limitation clause in that agreement. Nothing in these terms excludes liability for death or personal injury caused by negligence, fraud, or any liability that cannot lawfully be excluded.

9. Indemnity

You agree to indemnify and hold harmless Surgemint and its personnel against claims, losses and reasonable legal costs arising from your breach of these terms or your unlawful use of the site.

10. Privacy

Your use of the site is also governed by our Privacy Policy, which explains how we handle personal information and forms part of these terms.

11. Changes and termination

We may modify these terms at any time by posting a revised version with a new effective date. Continued use of the site after changes take effect constitutes acceptance. We may suspend or withdraw all or part of the site without notice.

12. Governing law

These terms are governed by the laws of the State of Texas, United States, without regard to conflict of law principles. The state and federal courts located in Travis County, Texas have exclusive jurisdiction, save that we may seek injunctive relief in any competent jurisdiction to protect our intellectual property.
